Welcome to Cacao Voyage. These Terms of Service ("Terms") govern your use of our website, www.cacaovoyage.com (the "Site"), and the purchase of products through our online store.

"Cacao Voyage" refers to Emerald Coast Pro Staffing, LLC, a Florida limited liability company doing business as (dba) Cacao Voyage. When we refer to "Company," "we," "us," or "our" in these Terms, we mean Emerald Coast Pro Staffing, LLC.

By accessing our Site or placing an order, you agree to be bound by these Terms in their entirety. These Terms incorporate by reference our Shipping & Delivery Policy, Refunds & Returns Policy, Legal Notice, and Privacy Policy. Please review all policies carefully before making a purchase.

1. Eligibility & Account Responsibilities

  • Eligibility: By using this Site, you represent that you are at least 18 years of age, or are using the Site under the supervision of a parent or legal guardian. If you are purchasing on behalf of a business, you represent that you have the authority to bind that business to these Terms.
  • Account Creation: If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.
  • Account Accuracy: You agree to provide current, complete, and accurate information for all orders and account details. Providing false information may result in order cancellation without refund.

2. Orders, Pricing & Payment

  • Order Acceptance: Placing an order constitutes an offer to purchase. Cacao Voyage reserves the right to accept, reject, or cancel any order for any reason, including but not limited to: product unavailability, pricing errors, suspected fraud, or orders that violate these Terms. If we cancel an order, we will notify you and issue a full refund.
  • Pricing: All prices are displayed in US Dollars (USD). While we make every effort to ensure accuracy, errors may occur. In the event of a pricing error, Cacao Voyage reserves the right to cancel the order and issue a refund rather than fulfill the order at the incorrect price.
  • Payment: We accept major credit cards, debit cards, and other payment methods as indicated at checkout. Payment is processed at the time of order placement. By submitting payment, you authorize us to charge the designated payment method.
  • Sales Tax: Applicable sales tax will be calculated at checkout based on your shipping address and current tax regulations.

3. Product Descriptions & Availability

  • Accuracy: We make every effort to accurately describe our products, including flavor profiles, cacao percentages, origin details, and ingredient lists. However, artisanal chocolate is a craft—minor variations in flavor, texture, or appearance may occur between batches due to the nature of small-batch, single-origin production.
  • Product Images: Product images are representative and may not precisely match the physical item received. Natural variation in chocolate color, surface texture, and molding is a hallmark of artisanal craft, not a defect.
  • Availability: Product availability is subject to change without notice due to the seasonal and small-batch nature of our partner farms in Panama, Belize, and Hawaii. We will notify you promptly if an ordered item is unavailable.

4. Shipping & Temperature Sensitivity

By placing an order, you acknowledge and agree to the terms set forth in our [Shipping & Delivery Policy], including:

  • Mandatory Summer Shipping: Orders placed between May 1st and October 31st must select the Summer Shipping option. Failure to do so constitutes acceptance of all risk for temperature-related damage, and Cacao Voyage is not liable for melting, blooming, or spoilage resulting from inadequate shipping protection.
  • International Shipping: You are solely responsible for all import duties, customs fees, and taxes imposed by your destination country. Cacao Voyage is not responsible for delays, seizures, or returns caused by customs authorities.

5. Refunds & Returns

All refunds and returns are governed by our [Refunds & Returns Policy]. Key points:

  • No returns or exchanges for change of mind.
  • Damaged or defective items must be reported within 48 hours with photographic evidence.
  • Temperature damage claims are only honored when Summer Shipping was correctly selected during the designated period.

6. User-Generated Content

If our Site allows you to post reviews, comments, or other content:

  • Ownership: You retain ownership of your content, but by posting it, you grant Cacao Voyage a non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display your content in connection with our business.
  • Responsibility: You are solely responsible for the content you post. You agree not to post content that is defamatory, offensive, misleading, infringing, or unlawful.
  • Moderation: Cacao Voyage reserves the right to remove or edit any user-generated content at our sole discretion without notice.

7. Website Use Restrictions

You agree not to:

  • Use the Site for any unlawful purpose or to promote illegal activity.
  • Attempt to gain unauthorized access to any portion of the Site, customer accounts, or our systems.
  • Use automated scripts, bots, or scraping tools to extract data from the Site without express written permission.
  • Reproduce, distribute, or commercially exploit any portion of the Site, including product descriptions, tasting notes, brand storytelling, or imagery, without prior written consent.
  • Resell Cacao Voyage products under a different brand identity or misrepresent the origin of our products.

8. Intellectual Property

All content on this Site—including but not limited to the Cacao Voyage name and logo, the "Ritual of Discovery," "The Cacao Voyage Tasting Journey," product photography, tasting notes, brand narratives, and website design—is the exclusive property of Cacao Voyage, LLC or its licensing partners. Unauthorized use is strictly prohibited and may result in legal action.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cacao Voyage, LLC, its officers, directors, employees, agents, and partner organizations (including Survivor-Led Solutions) from any and all claims, damages, losses, liabilities, and expenses—including reasonable attorney's fees—arising from:

  • Your violation of these Terms.
  • Your misuse of our products or Site.
  • Any content you submit or transmit through the Site.
  • Your failure to comply with applicable laws or regulations related to the import, purchase, or consumption of food products.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Cacao Voyage, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or enjoyment, arising from your use of the Site or our products.
  • Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.
  • We are not liable for delays or failures in performance resulting from circumstances beyond our control, including carrier delays, customs holds, natural disasters, or force majeure events.

11. Dispute Resolution & Arbitration

  • Governing Law: These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
  • Arbitration: Any dispute arising from these Terms or your purchase shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted in Palm Beach County, Florida. You waive any right to a jury trial or participation in a class action lawsuit.
  • Small Claims: Notwithstanding the above, either party may bring individual claims in small claims court in Palm Beach County, Florida, provided the claim is within the jurisdictional limit.

12. Modifications to These Terms

Cacao Voyage reserves the right to update or modify these Terms at any time without prior notice. Changes become effective upon posting to the Site. Your continued use of the Site or placement of additional orders after modifications are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

13. Severability

If any provision of these Terms is deemed unenforceable or invalid by a court, the remaining provisions shall continue in full force and effect.
