1. Food Safety & Allergen Warning
Cacao Voyage sells fresh, artisanal chocolate products. While we adhere to strict hygiene standards, our facility and partner farms handle various ingredients including dairy, nuts (tree nuts), and alcohol.
- Allergen Statement: Although we strive for purity, cross-contamination is possible in our supply chain. Please consult the specific packaging label for the most accurate allergen information before consumption.
- Health Advisory: Our products contain caffeine and theobromine. Consume in moderation. Not suitable for individuals with severe nut allergies unless explicitly stated as safe on the specific product packaging.
2. Perishable Nature & Temperature Liability
Our chocolate is a delicate, perishable luxury crafted from raw cacao beans. Its quality is dependent on strict temperature control.
- Mandatory Summer Protocol: As stated in our Shipping & Delivery Policy, orders placed between May 1st and October 31st MUST select the Summer Shipping option at checkout. This includes insulated packaging and ice packs.
- Limitation of Liability: Cacao Voyage is not liable for any melting, blooming, texture changes, or spoilage resulting from failure to select Summer Shipping during the designated warm months, or for delays caused by carriers outside of our control (including customs holds for international orders). By purchasing during these months without selecting Summer Shipping, the customer accepts all risks regarding temperature exposure.
3. International Sales & Customs
We ship globally to support our mission of connecting Panamanian, Belizean, and Hawaiian farmers with the world.
- Import Duties: Customers are solely responsible for all import duties, taxes, and customs fees imposed by their destination country. These fees are not included in the product price or shipping cost.
- Prohibited Items: Cacao Voyage is not responsible for packages seized or destroyed by customs authorities due to local regulations prohibiting the import of food items or specific agricultural goods.
4. Intellectual Property
All content on this website, including but not limited to the "Ritual of Discovery," tasting notes, brand story, product descriptions, images, and the "Cacao Voyage" trademark, is the exclusive property of Cacao Voyage and its partners (Nomé Chocolates, Maui Ku'ia Estate, etc.). Unauthorized use, reproduction, or distribution of this content is strictly prohibited.
5. Mission & Transparency
A portion of proceeds from every order supports anti-trafficking initiatives and fair-wage programs for farming communities through our partnership with Survivor-Led Solutions. 6. Limitation of Damages
To the fullest extent permitted by law, Cacao Voyage's total liability for any claim arising from the purchase or use of our products shall not exceed the purchase price of the specific product in question. We are not liable for indirect, incidental, or consequential damages, including but not limited to loss of enjoyment or emotional distress.
7. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
